Terms of Use

By accessing or using WillBazaar.com (the "Platform") and/or any services provided therein (the "Services"), you (the "User") signify your agreement to be bound by these Terms of Use (the "Terms"), our Privacy Policy, and any additional terms and conditions that may be applicable to specific Services. Please read these documents carefully.

If you do not agree to these Terms in their entirety, you are not permitted to access or use the Platform or the Services.

1. Eligibility

• Use of our Platform and Services is available only to persons who are above eighteen (18) years of age, are of a sound mind, are using the Platform out of their own volition, and are not disqualified from contracting by any law to which they are subject.
• As a minor, if you wish to use or transact on the Platform, such use or transaction shall only be made by a person of legal contracting age (legal guardian or parent). We reserve the right to block access to the Platform if it is discovered that you are a minor or incompetent to contract according to applicable laws.

Account

• You may need to register and create an account on the Platform ("Account") to access certain parts or sections of the Platform and avail/access Services. You agree to provide accurate and complete information during the registration process.
• You are responsible for maintaining the confidentiality of your Account credentials and for restricting access to your Account. Any and all actions performed by any person using your Account shall be deemed to have been committed by you, and you shall be liable for the same.
• You agree not to have more than one active Account on the Platform and are prohibited from transferring your Account to any third party or impersonating any other person for the purposes of creating an Account.
• We may restrict, suspend, or terminate your access to the Platform and/or Services if we believe, in our sole and absolute determination, that you have breached these Terms or our Privacy Policy.

3. Services

• We offer comprehensive succession planning consultancy and advisory services ('Services'), including will preparation, trust creation, allied document creation, and estate planning assistance, including online tools, information, assistance in preparing of legal documents, etc. The specific details and features of our Services may vary for each customer.
• We may offer different kinds of plans for the Services, each subject to different limitations, features, and restrictions, and the fees/charges for each plan may vary.

4. Fees and Payment

• To avail certain Services provided on a paid basis, you will be required to pay the applicable fees ("Services Fee").
• The Services Fee will be billed at the time of registration of the service, during checkout or annual basis for account renewals. You agree to make full payment of the Services Fee before you can access or receive the paid Services
• As a general matter, Services Fees billed are non-refundable and non-cancellable, except in limited circumstances such as technical payment errors as explicitly provided by us.
• We reserve the right to change, terminate, increase, decrease, or otherwise amend the Services plans, fees, or billing cycles at our sole discretion at any time, with advance notice to you. Your continued use of the Services after such changes will constitute your acceptance of the same.

5. User Obligations, Representations, and Warranties

• You agree to use the Platform and Services in compliance with all applicable laws and only for purposes for which they are permitted to be used.
• You represent, warrant, and covenant that you will fulfil all your obligations under these Terms and our Privacy Policy in good faith.
• You represent and warrant that you have all necessary rights in and to all information, documents, and materials you provide/share on the Platform and that no such information will violate, plagiarize, or infringe upon the rights of any third party, including intellectual property rights or privacy rights.
• If you provide us with personally identifiable or other information relating to any third party, you warrant that you have received that third party’s consent for such disclosure.

6. Restrictions on Use

• You specifically agree not to engage in any unauthorized commercial use or other unauthorized use of the Platform and the Services.
• You are prohibited from:
• Infringing or violating any third party’s rights (including intellectual property rights and rights of privacy).
• Posting, uploading, or transmitting any information that contains viruses or other harmful components.
• Trying to gain unauthorized access to the Platform or any Services.
• Using the Platform to collect personal information about other Users without their consent.
• Attempting to decipher, decompile, disassemble, or reverse engineer any of the software comprising the Platform.
• Using the Platform for any improper, unlawful, or immoral purpose.
• Creating applications or services that use our Platform’s content without our permission.
• Reproducing, transmitting, licensing, selling, or otherwise making available any materials or content from the Platform without our express authorization.

7. Intellectual Property Rights

• We are the exclusive owner and/or authorized user of all intellectual property rights appearing on or contained within the Platform, including all material, information, content, designs, and software. Your use of the Platform and/or Services does not grant you any right, title, interest, or license to such intellectual property rights, except for a limited, non-commercial, non-exclusive, non-transferable, revocable right to use, view, or download content or materials solely for the purpose of enabling you to avail the Services.
• You retain all rights in your data and information. You grant us a royalty-free, revocable, assignable, transferable, sub-licensable, worldwide right and license to use, modify, keep, share, save, copy, download, and/or utilize your data and information for the purpose of providing the Services to you and as set out in these Terms and our Privacy Policy.

8. Privacy

• We respect your privacy. Our Privacy Policy explains the nature and type of data we collect from Users, the usage, processing, storage, maintenance, transfer, sharing, and disclosure of such data, and the safety and security measures adopted by us to safeguard such data. By accepting these Terms, you agree that we can use, process, store, maintain, transfer, share, and disclose your data and other information in accordance with the Privacy Policy.

9. Disclaimer of Warranties and Limitation of Liability

• To the maximum extent permitted by applicable law, the Platform, all materials, Services, and content are provided on an "as is" and "as available" basis, without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
• We do not warrant that the Platform or Services will be uninterrupted, timely, secure, or error-free, or that any defects or errors will be corrected.
• In no event shall we, nor our affiliates, be liable for any loss or damage of any kind, whether direct, special, incidental, indirect, consequential, or punitive damages, arising out of or in connection with your use of or access to the Platform or the Services, regardless of the theory of liability.
• To the fullest extent permitted by applicable law, our aggregate liability arising out of or in connection with these Terms or the Services shall not exceed the amount of actual Services Fees paid by you.

10. Indemnification

• You agree to indemnify, defend, and hold harmless us, our affiliates, and our respective officers, directors, agents, employees, consultants, and representatives from and against any and all losses, liabilities, claims, damages, demands, costs, and expenses (including legal fees) arising out of or relating to:
  • (i) your breach of these Terms or our Privacy Policy;
  • (ii) your infringement or violation of any rights of a third party;
  • (iii) your use of the Platform or the Services; or
  • (iv) any incorrect or inaccurate information provided by you.

11. Termination

• We may terminate or suspend your Account and access to the Platform and/or Services at any time, with or without notice, for any reason, including but not limited to your breach of these Terms or our Privacy Policy.
• You may also choose to terminate your Account.
• Upon termination, your right to use the Platform and Services will cease immediately, and we may delete any information associated with your Account, subject to our data retention policies and applicable laws.

12. Governing Law and Jurisdiction

• These Terms shall be subject to and governed by the laws of the Republic of India. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Chennai.

13. Amendments

• We reserve the right to change, modify, amend, alter, or update these Terms at any time without prior notice. All modifications/amendments will be posted on the Platform and will become effective immediately upon such posting. Your continued use of the Platform and/or Services after such changes shall be deemed to be your agreement to the revised/modified Terms. You are advised to review these Terms periodically.

• If you wish to report a grievance, please provide a detailed description of your grievance, and we will endeavour to redress it within a reasonable timeframe as stipulated under applicable laws.

15. Entire Agreement

• These Terms, including our Privacy Policy and any additional terms (if applicable), constitute the entire agreement between you and us in relation to its subject matter and supersede any and all prior or contemporaneous promises, representations, agreements, statements, and understandings.
